HST TO PST – TRANSITION RULES FOR REAL ESTATE PROPERTY

WHEN DOES HST APPLY, AND WHEN DOES GST APPLY?
HST applies if tax becomes payable before April 1, 2013. GST applies where tax becomes payable after March 31, 2013. In addition, the BC transition tax may then apply where construction or substantial renovation is at least 10% complete on April 1, 2013.

WHEN DOES THE TAX BECOME PAYABLE?
Except for the sale of certain residential strata units, the tax is payable on the earlier of the following dates:

• when the seller transfers ownership (also known as the completion date) of the new home to the buyer, or
• when the seller transfers possession of the new home to the buyer under the Contract of Purchase and Sale.

WHEN DOES THE TAX BECOME PAYABLE WHEN THE TRANSACTION INVOLVES A STRATA UNIT?
The general tax payable rule will apply for strata’s except where the strata plan hasn’t been registered as a condominium by the date possession is transferred. The tax payable is then based on the earlier of the following dates:

• when the seller transfers ownership (also known as the completion date), OR
• 60 days following the date the strata plan is registered.

The BC government imposed it in 2010, voters rejected it in 2011 and in a matter of two short weeks or so the HST will go down into the history books of BC politics as one of the most controversial, if not contentious, taxes in history. Effective April 1^st, the Harmonized Sales Tax will be eliminated and a period of transition will commence with some significant changes in store for our industry, your buyers, your sellers and you as a REALTOR®. Here’s a snapshot of what to look out for leading up to April 1, 2013 and after:

• The 12 per cent HST applies if the possession or completion date is before April 1, 2013.
• The 5 per cent GST applies if the possession and completion dates are on or after April 1, 2013.
•  Effective April 1, 2013, builders will pay 7 per cent PST on building supplies and materials.

 
OUT WITH THE OLD, IN WITH THE NEW
The 2 per cent BC Transition Tax makes its debut April 1, 2013. It’s a tax, albeit a temporary one, your new home buyers need to know about:

• Applicable to the full purchase price of a new home which is 10 per cent or more complete by April 1^st and where completion and possession occur on or after April 1, 2013 but before April 1, 2015.
• The additional tax is aimed at providing a more even playing field for buyers of new homes both during and after the HST period.
• New housing transition rules will be in effect from April 1, 2013 – March 31, 2015 and apply to new housing only.

REBATES & INCENTIVES
With the demise of the HST comes the end of the New Housing Rebate program and the commencement of new incentives your new home buyers will want to know as being effective April 1^st :

• Properties less than $350,000 will qualify for a full federal GST rebate.
• Properties between $350,000 and $450,000 will qualify for a pro-rated federal GST rebate.
• Properties selling more than $450,000 will be exempt from rebate.

Where your buyer is purchasing a new home as a principal residence, be clear on the Contract of Purchase and Sale to specify whether the buyer will assign the GST rebate to the builder, be credited the rebate at closing or be themselves responsible for paying the GST on closing and apply to the government for the rebate. Your buyer can expect to wait about three months for a rebate to be processed and mailed.

Bamboo, floating shelves and dry stack Carrera tiles create a calming space in this busy family bathroom

Two functional main-floor family bathrooms get makeovers that up their fabulous factor

Two friends Ingrid and Haley recently redid their tired, outdated bathrooms to splendid effect.

In each case the homeowners had undergone a large-scale reno on an older home and saved the bathroom renovation for last. 

Both women also wanted something beautiful and functional for their young, growing families.

Here's what they ended up with.

Industrial Design Meets Calming Space

Ingrid is a serious style maven who pores over design websites in her spare time and has a home and wardrobe to match. She is also a hands-on mom and has an effortless way of pulling things together. She loves modern, industrial design and all things calming.

Ingrid’s worked alongside interior designer Margot Jagger to create a contemporary, yet hardworking space.

Her favourite feature of the bathroom is a floating bamboo shelf. It is a bit unexpected and extends over the sink and toilet creating a sense of flow throughout the small bathroom.

Even though the bathroom serves as a main floor powder room for guests, Ingrid installed a full-sized shower to hose down her golden retriever and three kids after a day at the park without having to traipse upstairs.

An existing off-centre, square window located along the dry stack, Carrera tile shower wall was left as is, but a niche was added to mirror the diminutive opening. It echoes the window in a playful way and creates balance.

Love the caged light from Blue Owl that Ingrid selected for over the custom, bamboo wood vanity and square sink from Robinson Lighting. Instead of having the light hard wired, an electrical socket was installed in the ceiling. It infuses the space with an industrial element that mimics features in the nearby kitchen. It also enables Ingrid to change the light on a whim.

Haley is a dietitian and active mom of two girls. When it came to her main floor bathroom, Haley was inspired by a photograph of a path through the woods that she spied in a friend’s powder room while living in London, England. Her husband is an outdoor photographer and there was also an interest in pulling the outdoors in.

Interior designer Tracey Ford worked with Haley to create a fun, whimsical space by juxtaposing black and white wallpaper of barren trees with a canary-yellow, high gloss, floating vanity. “The comfort of the forest combined with the flash of vibrant colour makes you feel like you are on a retreat,” she said.

A set of glass pulls and a chandelier relocated from the original dining room provide added drama.

Haley removed a shower in the bathroom and added a window as a natural light source. She is still looking for a side table, chair or otherwise perfect piece of furniture to complete the space.
